The Morning Link: People of Walmart Getting a Book

If you haven’t been to People of Walmart yet, prepare to be a little bit sad for your country. For those of you who know it and love it, the site is coming out with its own coffee table book so you can make fun of poor and crazy people with your friends.

    I’ve wondered about the legality of POW before. I know it is public pictures taken in public places and so it should be fair game, but it is done so with the express purpose of mocking the unknowing subjects.

    Seems like libel?

    Definitely not libel. Libel must be written, for one, and to be found guilty of libel, it must be shown that whoever wrote the text at issue either knew or had good reason to know that what they were writing was false.

    Generally, you need a release from the person(s) for a profit-centered thing (book, TV show, etc.). Just taking a picture in a public place to put it in a scrapbook is fine, making money off it, usually not. Laws vary, of course.

    I don’t know if I should feel bad about laughing at these pics, though. I’ve looked pretty rough some mornings, though I tend to wear collared shirts and jeans, not spandex or mumus.

    Right – the general idea is that if the person’s image is used for advertising purposes, you need consent. Otherwise, it’s pretty much fair game. I imagine with the increase in technology and accessibility into people’s private lives, we will see legislation that will curb this idea.
